This has a reference to my
and other colleagues various correspondences and e-mails on the captioned
subject. In this connection, we agree with the company’s plea that
sanction of the plan is entirely in the hands of Govt. deptts. Of Haryana,
which has not yet been received but we donot subscribe to your contention
that without having received the sanction of the plan company has communicated
to all the flat bookers vide their letter of 2nd sept. that
the plan for atharva has been approved by the Director, Town and Planning
Haryana. This misleading and concocted statement had given confidence
in the minds of the flat bookers that the progress of construction of
flats is now visible but that was a dream on account of false statement
in your letter of date.
I being a senior citizen has
paid Rs.15.60 lacs till date while from many bookers you have accepted
only first instalment. Am I not entitled for the interest on the excess
money deposited with you as compared to other flat buyers?
Now I understand that letter
for next instalment have been sent to the prospective occupants, while
they including me can not raise loan from any financial Institution
without sanctioned plan. SMS received by me at 11.43 A.M today
from tel. no. 9987545108 for payment of next instalment by 19.11.08
to avoid intt. In this connection I have already intimated the facts
to you vide my letter of 04.11.08 sent by Speed Post through my advocate,
copy of which is attached.
Head of Home department of
SBI for entire NCR Shri K.S.Pahwa ( Tel no. 98182*****) called on Shri
Naveen Bahl on 06.09.08 for getting some documents for getting “Atharva”
project approved by the bank from their Corporate centre, Mumbai, so
that in the meantime loans could be sanctioned and disbursement will
be made on receipt of sanctioned plan. To my utter surprise despite
many calls to him and trips to your office, he has not bothered and
avoiding for the reasons best known to him. Can you please instruct
him that in Company’s intt. He should furnish the requisite papers
to the bank for approval by the bank ( no document asked by the bank
is confidential)?
Now we have following specific queries / clarifications:
a. How much more time it will take to receive the hard copy of the sanctioned plan?
b. A letter from the company to all the persons who have booked flat in Atharva ( An ISO 9001:2000 certified company) stating therein that no interest will be charged on instalments falling due till copy of sanctioned plan is handed over to them and a cushion period of 15 days for sanction and disbursement of loan.
c. Builders buyer’s agreement were executed by the flat bookers between 12 to 19.09.08 but till date they have not received their copy and your office is withholding the same. When these will be sent?
d. When documents for approval of Atharva project will be handed over to State bank of India as their rate of interest is atleast 0.5% cheaper than other nationalized and private banks? As without approval of the project, they donot entertain the loan application.
e. Please advise your staff to atleast reply to the letters and mails of the customers with a view to retain confidence in your company.
f. In case company desires we
can also take up the matter with the Director, Town and Country Planning,
Haryana for expediting the plan.
